References to the “Terms” and/or “Agreement,” mean this, these Terms & Conditions as set forth herein. • References to “us”, “we”, “our” and/or “the company” mean SmartValuez. • References to “you”, “customers” and/or “users” mean the User of the Website. • References to the “Site” mean the Websites bearing the URL www.smartvaluez.pk, info@smartvaluez.pk, sales@smartvaluez.pk, support@smartvaluez.pk, and Our apps (SmartValuez Android and iOS Apps which is still under process)

You Agree to

By using our Site, you are agreeing to these Terms. Please read them carefully as they constitute the terms and conditions of a legally binding agreement between you and the company. You agree that you are solely responsible for any breach of your obligations under this Terms and for the consequences (including any loss or damage which Site may suffer) of any such breach. Using our Site, even after any change in Terms, you are agreeing to these Terms. If you don’t feel comfortable with agreeing to these Terms as they are, please stop using our Site, although we’ll be sorry to see you go.

Your SmartValuez Account

Users may be given the opportunity to register via an online registration form to create your account that may allow you to receive information from us and/or to participate in certain features or access of the Site. We will use the information you provide in accordance with our Privacy Policy. With respect to any such registration of your Account, we may refuse to grant to you the username you request. You are responsible for: • Providing the current, complete and accurate information, at the time of registration of your SmartValuez account, to the best of your knowledge; • Maintaining and promptly updating your registration information on the Web site so that it remains current, complete and accurate; • Creating the password at the time of registration. You also acknowledge and agree that we may rely on this password to identify you; • All use of your Account, regardless of whether you authorized such access or use, and for ensuring that all use of your Account complies fully with the provisions of these Terms of Service; • Using this account for personal or individual use only; • All activities that occur under your Account.

Prohibited Uses of Our Site

To protect our Site from being misused, we have made some rules that apply to every user equally. These rules have been erected solely to ensure that every SmartValuez user enjoys the experience on our Site without interruption. We reserve the right to terminate your use of the Site and/or the Account for violating any of the prohibited uses or for any other reason in our sole and exclusive decision. You specifically agree not to: • Access or attempt to access the Site, or any portion thereof, through any automated means, including but not limited to the use of scripts or web crawlers; • Engage in any activity that disrupts or otherwise interferes with the Site (or the servers and networks which are connected to the Site; • Duplicate, reproduce, copy, sell, trade or resell the Site for any purpose; • Access the Site other than through the interface that is provided by SmartValuez.pk unless you have specifically been permitted to do so in a separate written agreement signed by an authorized representative of SmartValuez; • Use Site for purposes that are not permitted by this Terms & Condition and against any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions.

Prices

Base Currency

All fees and prices are in PAKISTAN RUPEES (PKR). You might see prices/fees in your local currency based on standard currency exchange. Changing of Prices Site prices are subject to modification at any time. Prices may also vary due to a launching price, a promotional offer or sales. Prices of items that are not in stock or that are available for a preorder are valid during its promotional period after the order was placed. Should the price of those items change with respect to the pre-order price, Customer will be informed and will have the possibility to cancel the order. We reserve the right to update prices displayed on the Site from time to time and once updated, they cannot be claimed against an order that has already been confirmed or delivered.

Typographical Errors

We strive for accuracy in all item’s descriptions, photographs, compatibility references, detailed specifications, pricing, links and any other product-related information contained herein or referenced on our Site. Due to human error and other determinates we cannot guarantee that all item descriptions, photographs, compatibility references, detailed specifications, pricing, links and any other product-related information listed is entirely accurate, complete or current, nor can we assume responsibility for these errors. In the event a product listed on our Web site is labeled with an incorrect price due to some typographical, informational, technical or other error, we shall at our own sole discretion have the right to refuse and/or cancel any order for said product and immediately amend, correct and/or remove the inaccurate information. Additionally, all hyperlinks to other websites from our Site are provided as resources to customers looking for additional information and/or professional opinion. We do not assume responsibility for the claims and/or representations made on these or any other websites.

Orders

Placing an Order

Placing an order can be done from the Site. Should you place the order from the Site, you have to be sure that personal data is correct and updated. In order for us to send response e-mail not to the wrong email address and to deliver your order not to the wrong delivery address, we suggest Customers to review the order form several times before validating the order.

Order Processing Time

You can expect your order to be processed within approximately 24-48 hours, provided the items are in stock and there are no problems with payment verification. We do not guarantee same dayshipping. Orders are not processed on weekends and holidays of United Arab Emirates.

Order Acceptance Policy

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right, at any time after receipt of your order, to accept or decline your order for any reason. We reserve the right, at any time after receipt of your order, to supply less than the quantity you ordered of any item without prior notice to you. We may require additional verifications or information before accepting any order.

Order Acknowledgement

We will keep you informed of your order status via e-mail. All tracking information will be emailed to your registered email-ID once your order has processed or changed its status. You may also acquire your order status and other live updates by logging in to your Account on our Site.

Cancel Orders

You may request for order cancellation, provided the order has not already been processed and shipped. Use this guide to cancel your order.

All product images are for illustrative purposes only and may differ from the actual product due to product enhancement. Due to differences in monitors, colours of products may also appear different to those shown on the site.

Payment

We currently offer the following payment methods: • Online Payment: Pay by Card (Online) [Recommended]: You can make the payment online using Master or Visa Card. • Payment at the time of Delivery (For UAE and Pakistan Only): o Cash on Delivery (CoD): You can pay cash to our representative delivering your product. In order to protect the Site visitors to the best of our knowledge, we implement several security policies and certificates. These layers of protection could be by-passed if the user computer is/was infected with a virus or malicious software. SmartValuez or its associated partners and employees cannot be held responsible in such a scenario or circumstance. We reserve the right to refuse a delivery or honor an order from a Customer who has not paid part or the totality of a previous order or with whom a litigious dispute is in progress. We also reserve the right to take any necessary steps including legal action in case of outstanding or non-payment of fees by you.

Invoice

The order form filled out online by the Customer cannot be considered as an invoice. Regardless of the purchase or payment methods, the Customer receives an invoice inside his/her parcel when it is delivered. A digital copy of each invoice is registered in our secure and encrypted data base.

Security

We will take all reasonable precautions to ensure the security of any payment details included in your order nevertheless, barring direct negligence on our part, we cannot be held liable for any losses incurred as a result of unauthorized access to information you may provide. Disputes

If any dispute, claim, controversy or difference (including in relation to any tortious or statutory claim) (“Dispute”) arises out of or in connection with or in relation to this User Agreement, including (without limitation) any question regarding the formation, existence, scope, performance, interpretation, validity or termination of this User Agreement or this clause, or any question regarding the legal relationships established by this User Agreement or the consequences of its nullity, then the parties shall first attempt amicably to settle the Dispute through good-faith negotiations over a period of thirty (30) calendar days commencing on the date that a party first sends to the other party a written notice of the Dispute. In the event that a Dispute has not been settled amicably by the relevant parties by the end of such thirty (30) calendar day-period, the parties hereby agree that the Dispute shall be referred to and finally resolved by binding arbitration as set out.  

Transfer of Rights and Obligations

You hereby grant SmartValuez the right to, and irrevocably acknowledge and agree that SmartValuez may at any time, transfer all or any part of its rights, benefits, obligations or liabilities (whether express or assumed) under this User Agreement to any of its affiliates without requiring your further specific agreement. SmartValuez agrees to use all reasonable endeavors to provide notice to you of any transfer by way of a posting on the Site. You may not at any time, without the prior written consent of SmartValuez, transfer all or any part of your rights, benefits, obligations or liabilities (whether express or assumed) under this User Agreement without the prior written consent of SmartValuez.

Should you have any questions, comments or concerns regarding the Site and/or Services customer service may be contacted at any time via support@smartvaluez.pk. We strive to return all customer service inquires within forty-eight (48) business hours.

Feedback

You may have the opportunity to provide reviews, suggestions, ideas, and feedback, (hereinafter, collectively, “Feedback.”) Should you so provide such Feedback you grant us sole ownership of the same, which includes without limitation the right for us or any Third Party we designate, to use, copy, transmit, excerpt, publish, distribute, publicly display, publicly perform, create derivative works of, host, index, cache, tag, encode, modify and adapt (including without limitation the right to adapt to streaming, downloading, broadcast, mobile, digital, thumbnail, scanning or other technologies) in any form or media now known or hereinafter developed. All such Feedback shall be treated as non-confidential. If it is determined that you retain moral rights (including rights of attribution or integrity) in the content submitted by you, you hereby declare that: (a) you do not require that any personallyidentifying information be used in connection with the content, or any derivative works of or upgrades or updates thereto; (b) you have no objection to the publication, use, modification, deletion and exploitation of the content by us or our licensees, successors and assigns; (c) you forever waive and agree not to claim or assert any entitlement to any and all moral rights of an author in any of the content; (d) you forever release us, and our licensees, successors and assigns, from any claims that you could otherwise assert against us by virtue of any such moral rights. You also permit any other User to access, view, store or reproduce the content for that Users personal use. We reserve the right to modify or delete your feedback, if it contains the content against SmartValuez or its affiliated business partners. You also agree not to use any pseudo name or fake identity to post feedback. We will delete feedback from pseudo accounts and might take legal action against the feedback poster. Notwithstanding the foregoing, you acknowledge that your Feedback may contain concepts, ideas, materials, proposals, suggestions and the like relating to Site or its initiatives, (hereinafter your “Ideas.”) With respect to your Ideas you acknowledge that: (a) we receive numerous submissions from many parties and/or may have independently developed and/or considered ideas similar to your Ideas, and that our review of your Ideas is not an admission of novelty, priority or originality; (b) our use of any ideas similar to your Ideas, whether based on your Feedback or Submissions, provided to us by Third Parties, or independently developed or considered by us, shall be without obligation to you.

LIMITATIONS OF LIABILITY

IN ALL CIRCUMSTANCES SMARTVALUEZ’S MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS SOLD. SMARTVALUEZ SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. SMARTVALUEZ SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS OR DAMAGE TO EXEMPLARY DAMAGES, WHETHER OR NOT SMARTVALUEZ HAS BEEN MADE AWARE OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES. If you are dissatisfied with the Site or any content or materials on it, your sole exclusive remedy is to discontinue your use of it. Further, you agree that any unauthorized use of the Site and its services as a result of your negligent act or omission would result in irreparable injury to SmartValuez and we shall treat any such unauthorized use as subject to the Terms. We reserve the right to cancel any unpaid order under any circumstances without any owed liability towards customer or otherwise, in-case of paid order we still reserve this right as long as paid amount is returned in full.

Intellectual Property

All content included on the Site, such as text, graphics, logos, images, audio clips, video, data, music, software, and other material (collectively “Content”) is owned or licensed property of SmartValuez or its suppliers or licensors and is protected by copyright, trademark, patent, or other proprietary rights. The collection, arrangement, and assembly of all Content on the Site is the exclusive property of SmartValuez. We and our suppliers and licensors expressly reserve all intellectual property rights in all Content.

Governing Law

This User Agreement is governed by, and construed in accordance with,PAKISTAN  law. This clause will survive any expiry or cancellation of this User Agreement for any reason.

Updates

We may from time to time modify or change the Terms. The revised Terms will govern your future use of our Site, so we strongly suggest that you visit and review our Terms periodically. Each version is specifically dated. If you do not agree to the revised version, you must immediately stop using our Site.

WARRANTY POLICY

All warranty periods indicated are from SmartValuez, unless otherwise noted, and are limited by the manufacturer’s warranty policies. Actual manufacturer warranty periods may vary depending on product and manufacturer and may be longer than the warranty period covered by SmartValuez. Please refer to the manufacturer’s website or product manuals/packaging for more information. Generally, the manufacturer’s limited warranty will only cover the product for manufacturing

Claimable Product(s)

Product(s) can be claimed for warranty based on the following conditions: • Product(s) should not be in used condition and should not show that it was previously used. • Save the original seal. • No software should be installed or deleted. • No unauthorized software should be installed. • Product(s) should have the complete original packaging (if product was sold in original packaging). • Saved accessories, consumables included with the Product(s), components, labels, accompanying documentation and software, and etc. • Physically damaged and/or missing Product(s) cases will only be considered if reported at the time of delivery. Unclaimable Product(s) Product(s) that cannot be claimed for warranty based on the following conditions: • Non-warranty products (refer to Quick and Hassle-free warranty). • Cables wires, cords, cables which are released by the meter CD, Cartridges, or any Consumable product. • Product(s) which are refurbished or sold with a special super low price (Marked down products, Flash Sales, Seasons Sales, Special offers, Today Deals, Open Box, Daily Deals or any other Product(s) which have been sold with discount) • Hygiene and personal care Product(s) that include but not limited to; wax, perfumes, cosmetics, and etc. • Physically damaged Product(s) • Missing or incomplete Product(s) • Free-size or Multi color Product(s) cannot be claimed. (Product(s) listed on the Site as multicolor, free-size, assorted color, assorted design, etc. are items on which size/color cannot be guaranteed and is subject to availability.) • Product(s) accessories (only main item can be claimed for warranty)

Refund Policy

To claim for a Refund, please check if the purchased Product(s) fall under the warranty as per the Warranty Policy. If the Product(s) fall under warranty, then you can claim for Refund based on the following conditions: • Customer can claim for Refund for the purchased Product(s) within 3 working days from the date of receiving the Product(s). • After the 3 days of the delivery, Product(s) can only be repaired as per the Repair policy. • Physically damaged and/or missing Product(s) cases will only be considered if reported at the time of delivery. • Amount of the Refund only covers the amount of Product(s) purchased. • Shipping and payment processing charges are non-refundable • If a coupon, discount, or special offer was part of the original order, the amount will be deducted as well. • Refunds will be made through the original mode of payment selected at the time of order generation. • SmartValuez reserves the right to compensate the claim in terms of Coupon as and when it deems fit.

Refund Process

If the Product(s) is qualified for the Refund, then please follow the below process to claim for a Refund: • 1. Raise a Complaint: Use this guide to raise a complaint and save Complaint Number for future reference. • 2. Review: Our support team will review the case and approve the Refund, if qualified. • 3. Pickup Process: Once the complaint is approved, the product pickup process will start. o a. Within PAKISTAN: The Product(s) will be picked up by our delivery team for PAKISTAN customers. o b. Outside PAKISTAN: Customer will have to return the Product(s) at his/her own expense to SmartValuez Business Address at TECHNO SMART TRADERS INTERNATIONAL  4 UMER STREET NEW ZIKRIA TOWN MULTAN • 4. Inspection Process: After receiving the Product(s), it is sent for inspection: o a. Approved: If the Product(s) is found faulty as per the policy then the Refund process will be initiated. o b. Not Approved: For Product(s) not faulty and claimed due to the Product(s) not being as per expectations, pickup charges of (PKR 200) are applicable only within PAKISTAN.

Return Policy

To claim for a Return, please check if the purchased Product(s) falls under the warranty as per the Warranty Policy. If the Product(s) is under warranty, then you can claim for Return based on the following conditions: • Customer can claim for Return for the purchased Product(s) within 3 days from the date of receiving the Product(s). • After the 3 days of the delivery, Product(s) can only be repaired as per the Repair Policy. • Physically damaged and/or missing Product(s) cases will only be considered if reported at the time of delivery. • Amount of the Return only covers the amount of Product(s) purchased. • Shipping and payment processing charges are non-refundable. • If a coupon, discount, or special offer was part of the original order, the amount will be deducted as well. • Returns will only be made via Coupons that can be used to order again the same, similar or any other Product(s) of your choice. Inspection Process: After receiving the Product(s), it is sent for inspection: o 1- Approved: If the Product(s) is found faulty as per the policy then Return will only be made via Coupons that can be used to order again the same, similar or any other Product(s) of your choice. Please refer to the Coupon Usage Policy. o 2- Not Approved: For Product(s) not faulty and claimed due to the Product(s) not being as per expectations, will be returned back to the customer. Repair Policy To claim for a Repair, please check if the purchased Product(s) fall under the warranty as per the Warranty Policy. If the Product(s) is under warranty, then you can claim for Product(s) Repair based on the following conditions: • Physically damaged and/or missing Product(s) cases will only be considered if reported at the time of delivery. • SmartValuez reserves the right to compensate the claim in terms of coupon instead of repairing the Product(s) as and when it deems fit. • SmartValuez can facilitate warranty service between you and the manufacturer for retail Product(s) but will not cover any expenses incurred for warranty service. • SmartValuez is limited to the service level offered by the manufacturer or supplier, please read your product warranty information carefully before contacting us.

Repair Process

If the Product(s) is qualified for the Repair, then please follow the below process to claim for a Repair: • 1. Raise a Complaint: Use this guide to raise a complaint and save Complaint Number for future reference. • 2. Review: Our support team will review the case and approve it, if qualified. • 3. Pickup Process: Once the complaint is approved, the product pickup process will start. o a. Within UAE: The Product(s) will be picked up by our delivery team for PAKISTAN customers ▪ 1- There will be no pickup charges if claim has been raised within 3 days of the delivery ▪ 2- Pickup charges of PKR 200 will be applicable if the claim is made after 3 days of delivery o b. Outside PAKSITAN: Customer will have to return the Product(s) at his/her own expense to SmartValuez Business Address at Techno Smart Traders 4 Umer Street New Zikria Town Multan  • 4. Inspection Process: After receiving the Product(s), it is sent for inspection: o a. Approved: If the Product(s) is determined to be defective and it is covered by our warranty policy, customer will be informed and the Product(s) will be shipped out as soon as possible when it is ready. For any defective Product(s) you will have to wait an estimated 2~6 weeks until SmartValuez gets a replacement or repaired Product(s) back from the manufacturer or supplier. o b. Not Approved: For Product(s) not faulty and claimed due to the Product(s) not being as per expectations, will be returned back to the customer.

Quick and Hassle-free Warranty

Products with no specific warranty period are deemed as non-warranty items and complaint needs to be filed within 24 hours from the date of delivery. Claims to be accepted based on the following conditions: • Product(s) should not be in used condition and should not show that it was previously used • Save the original seal. • No Software should be installed or deleted. • Product(s) has the complete original packaging (if product was sold in original packaging). • Saved accessories, consumables included with the Product(s), components, labels, accompanying documentation and software, etc. and their packaging is not damaged. • Physically damaged and/or missing Product(s) cases will only be considered if reported at the time of delivery. • SmartValuez reserves the right to compensate the claim in terms of coupon instead of servicing the item as and when it deems fit. • For items not faulty and claimed due to the item not being as per expectations, pickup charges of (PKR 200) and re-stocking fees (15% of product value) are applicable. • Free-size or Multi color Product(s) cannot be claimed for exchange/return. (Product(s) listed on the Site as multi-color, free-size, assorted color, assorted design, etc. are items on which size/color cannot be guaranteed and is subject to availability

Additional Terms and Conditions; EULAs ( G2A Payment Service Provider )             



When you use G2A Pay services provided by G2A.COM Limited (hereinafter referred to as the “G2A Pay services provider”) to make a purchase on our website, responsibility over your purchase will first be transferred to G2A.COM Limited before it is delivered to you.

G2A Pay services provider assumes primary responsibility, with our assistance, for payment and payment related customer support. We and/or entities that sell products on our website are primarily responsible to users for any liabilities related to fulfillment of orders, and EULAs entered into by the End-User Customer. G2A Pay services provider is primarily responsible for facilitating your payment.

You are responsible for any fees, taxes or other costs associated with the purchase and delivery of your items resulting from charges imposed by your relationship with payment services providers or the duties and taxes imposed by your local customs officials or other regulatory body.
